California Gov Jerry Brown Signs New Gun Bill Into Law, Permitting Door-To-Door Seizure Of Guns, Gun Confiscation - What To Do



California Governor Jerry Brown signed into law Wednesday a measure that increases funding to confiscate the tens of thousands of weapons “owned illegally” throughout the state.
SB 140, authored by Mark Leno (D-San Francisco), allocates $24 million for the state Department of Justice’s Armed and Prohibited Persons program. The money will go to hire more agents to confiscate the weapons and reduce the backlog over the next three years — to identify and seize assault weapons owned by convicted criminals and individuals with serious mental illnesses.

out of the hands of potentially dangerous people who are prohibited from having them. Senate Bill 140, authored by Senator Mark Leno and Senate President pro Tempore Darrell Steinberg, appropriates $24 million to the California Department of Justice (DOJ) to enhance the identification and confiscation of handguns and assault weapons that are in the hands of convicted felons, persons who are determined to be mentally unstable, and others who have criminal backgrounds that prevent them from legally possessing guns. The bill becomes law immediately because it was designated as an urgency measure. “I applaud Governor Brown for signing into law this important legislation that addresses California’s growing backlog of illegally possessed firearms,” said Senator Leno, D- San Francisco. “While our state is the only one in the nation that has a system to track and identify persons who at one time made legal purchases of firearms but are now barred from possessing them, until now we have lacked sufficient resources to take back those weapons. We know for the safety of our communities that these people should not possess guns, and our reinvestment in this tracking program gives us the opportunity to confiscate them.” SB 140, which was introduced in late January, received bipartisan support in both the Senate and Assembly. It is the first bill addressing gun violence to make it to the Governor’s desk this year. “California is leading the nation in a common-sense effort to protect public safety by taking guns away from dangerous, violent individuals who are prohibited by law from owning them,” said Attorney General Kamala Harris. “These funds will allow the Department of Justice to increase the number of agents conducting these smart and effective operations. I commend Governor Brown for signing this critical public safety investment into law.” The Bureau of Firearms has identified about 20,000 Californians who illegally possess an estimated 40,000 handguns and assault weapons. Every day, this list of prohibited persons owning firearms grows by 15 to 20. SB 140 directs $24 million of surplus funds from the Dealer Record of Sale account for the DOJ to enforce the department’s existing Armed Prohibited Persons System (APPS) program.  MORE

The armed door-to-door manhunt in Boston raised eyebrows by supporters of the Constitution, so what will their reaction to the California confiscation of guns be?
“Today, each California community is a step closer to being safer,” Senate President Pro Tem Darrell Steinberg (D-Sacramento) said in a statement. “This swift action by the Legislature and the Governor to enforce the laws we already have is a wise and worthy investment to reduce gun violence.”
They collectively own more than 39,000 handguns and 1,670 assault weapons but are prohibited from owning firearms because they have been convicted of crimes, ruled mentally unstable or are subject to domestic violence restraining orders.
Leno’s bill was one of 30 gun control bills authored by California legislators in the wake of the Sandy Hook shooting massacre in Newtown, Connecticut.
Other measures include background checks on ammunition purchases, a requirement that all gun owners use lock boxes and expanding the list of criteria one must meet before owning a firearm.  MORE


Gun Confiscation – What to Do



In discussions about SHTF scenarios among my fellow gun-nuts, occasionally the talk turns to hiding your guns from the authorities. Caches, hidden compartments, hideaways and the like. My contention is that if you’re hiding your guns from the authorities, it’s already too late.
In New Orleans, the word is that the authorities came looking for firearms under the auspices of clearing out the city – even the sections not yet flooded. Lots of YouTube videos show national guard and police units knocking on doors with weapons at the ready.  The video included in this post shows cops and NG units from neighboring states going into homes.
Citizens were assaulted and disarmed in a number of well-documented cases, including the confiscation of long arms out on the water as men were recovering their property and evacuating. In one scene, the NOPD or other authorities came all tacticooled-up and flex-cuffed property owners. Ultimately, the cops allowed them to stay in their homes but left them largely defenseless.
I believe in law and order, but I don’t know what I would do if a National Guard trooper showed up and told me I had to leave and that he wanted my guns. In that situation, I would have no initiative even if I were prepared to engage in violence against a 19 year old kid and his buddy who, like I did a bajillion years ago, signed up to defend his country. MORE

Fortunately in CA, the team who shows up to collect your guns has no actual legal authority to do so, and is forced to resort to coercing you to give them over voluntarily. With practice, they have become GOOD at it. The defense? Insist they leave your property and come back with a warrant. They can't get one.

As for what to do in a confiscation scenario? That's easy. Kill them. I have no pity for government personnel who swear to defend the Constitution and then willingly follow orders to violate it. Nuremberg established the right, and necessity, of a soldier to reject and disobey unlawful orders. They make the choice, and accept the consequences of directing deadly force against another human being. I stand a high risk of losing such an encounter, but dying defending my rights and liberty is FAR more preferable to me than the lifelong nightmare of living with the shame of having willingly submitted to forfeiting my freedom for such a pittance as a little more life, such as it would be. When they confiscate, kill.
